UltraRacing.com (the "Site") is operated by Throwdown Performance, LLC ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of the Site and every purchase you make from us. By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site or place an order.
PLEASE READ SECTIONS 4 (CANCELLATIONS, RETURNS AND REFUNDS), 9 (WARRANTY DISCLAIMER) AND 10 (LIMITATION OF LIABILITY) CAREFULLY. THEY LIMIT YOUR REMEDIES AND OUR LIABILITY.
1. Use of the Site
You agree to use the Site for lawful purposes only and not in any way that could damage, disable, overburden, or impair the Site or interfere with anyone else's use of it.
2. Product Information, Pricing and Availability
We work to keep product descriptions, images, fitment information, pricing and availability accurate, but errors can occur. We may correct errors, change prices, or discontinue products at any time without notice. If a product is listed at an incorrect price or with incorrect information, we may cancel any order for that product and refund the amount paid, even after the order has been confirmed.
3. Fitment Is the Buyer's Responsibility
Ultra Racing is based in Malaysia, and its parts are designed and tested on the chassis of vehicles sold in its home market. US and North American versions of the same model can differ in chassis, subframe, mounting points, steering position, drivetrain, exhaust routing, and the location of fuel or brake lines. As a result, a part listed for your model may not fit your vehicle without modification, or may not fit at all.
Fitment information on the Site, including the vehicle selector, is a guide only and is not a guarantee of fit. Before ordering, you are responsible for confirming that the part is correct for your specific vehicle, including its make, model, year, trim, drivetrain, market of origin, and any modifications. Do not rely on the model name alone.
If you are unsure, contact us at support@ultraracing.com before you order. Include your VIN or full vehicle details, photos of the mounting locations, and the measurements between the mounting points (bolt center to bolt center). We will compare them against the manufacturer's specifications where they are available. This review is provided as a courtesy. It is not a guarantee of fit, and responsibility for confirming fitment remains with you. A part that does not fit your vehicle is not a defect or an error on our part. It may be returned only under the standard return terms in Section 4, including the charges described there, and only if it has not been installed or test-fitted.
4. Cancellations, Returns and Refunds
ORDERS CANNOT BE CANCELLED ONCE SUBMITTED. RETURNS ARE ACCEPTED ONLY AS DESCRIBED IN THIS SECTION. EVERYTHING ELSE IS FINAL SALE.
Return window and condition. You may request a return within 14 days of delivery. The item must be unused, never installed or test-fitted, free of marks or damage, and in its original, undamaged packaging with all hardware and instructions. You must obtain a Return Authorization (RA) from support@ultraracing.com before sending anything back. Returns sent without an RA will be refused. Approved returns must be shipped back within 7 days of the RA being issued.
Final sale items (not returnable). Special-order, pre-order and custom items, including any part ordered from the manufacturer specifically to fill your order; clearance items; and any item that has been installed, test-fitted, modified or painted.
Charges on returns. Unless the return is due to our error, transit damage or a manufacturing defect, your refund will be reduced by: (a) the actual cost we paid to ship the order to you, including on orders that shipped to you free of charge; and (b) a restocking fee of 15% of the price of each returned item. You pay for return shipping and bear the risk of loss until we receive the item, so we recommend an insured, tracked service. We inspect every return. Items that arrive used, damaged or incomplete will be refused and sent back to you at your expense. Approved refunds are issued to the original payment method within 10 business days of our receipt of the item.
Our errors, transit damage and defects. If we shipped an item other than the one you ordered, or the item arrived damaged in transit or with a visible manufacturing defect, notify us at support@ultraracing.com within 7 days of delivery with your order number and photos of the item and packaging, and keep the item uninstalled. We will repair, replace or refund the item, and cover return shipping, at no charge to you. This is your sole and exclusive remedy for these issues. Defects found after installation are covered only by the manufacturer's warranty described in Section 9.
Refused and undeliverable shipments. Orders that are refused, undeliverable or returned to sender are treated as returns, and the charges above apply, along with any return freight we are billed.
Chargebacks. You agree to contact us and give us a reasonable opportunity to resolve any problem before disputing a charge with your card issuer or payment provider. We will contest chargebacks filed on orders that were delivered as described, and we may provide these Terms, your order details and delivery records as evidence.
5. Payment
We accept payment through the approved methods shown at checkout. You agree to provide current, complete and accurate purchase and account information, and you authorize us to charge the payment method you provide for the full order total, including applicable taxes and shipping.
6. Shipping, Delivery and Risk of Loss
Shipping timelines are estimates and may vary with product availability, destination and carrier. Title and risk of loss pass to you when we deliver the product to the carrier. We are not responsible for carrier delays. Visible shipping damage should be noted with the carrier on delivery and reported to us under Section 4.
7. Installation, Use and Assumption of Risk
Chassis braces, sway bars, arms and similar components alter how a vehicle handles and must be installed correctly to perform safely. We strongly recommend installation by a qualified professional. You are solely responsible for proper installation, torque specifications, inspection, and the use of the vehicle after installation. Installing aftermarket parts may affect your vehicle's factory warranty, handling characteristics, insurance, or compliance with local laws, and it is your responsibility to confirm these before installation. Use of any product in racing, track, competition or off-road driving is at your own risk.
8. Intellectual Property
All content on the Site, including text, images, logos, product descriptions and software, is the property of Throwdown Performance, LLC or its suppliers and is protected by intellectual property laws. You may not use any content without our express written permission.
9. Warranty Disclaimer
Products are covered only by any written warranty provided by the manufacturer, Ultra Racing, under that warranty's terms. Throwdown Performance, LLC does not provide any warranty of its own. TO THE EXTENT PERMITTED UNDER NEW JERSEY LAW, THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS," AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
10. Limitation of Liability
TO THE EXTENT PERMITTED UNDER NEW JERSEY LAW: (A) WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING INSTALLATION OR REMOVAL LABOR, TOWING, VEHICLE DOWNTIME, DAMAGE TO OTHER VEHICLE COMPONENTS, LOST EVENT OR TRACK FEES, OR LOST PROFITS, ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCT; AND (B) OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. Nothing in these Terms limits liability for personal injury caused by our negligence or for any other liability that cannot be limited under New Jersey law.
11. Indemnification
You agree to indemnify and hold harmless Throwdown Performance, LLC and its owners, employees and agents from any claims, losses and expenses, including reasonable attorneys' fees, arising from your improper installation, misuse or modification of any product, or your violation of these Terms.
12. Governing Law and Venue
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or any purchase shall be brought exclusively in the state or federal courts located in Monmouth County, New Jersey, and you consent to the personal jurisdiction of those courts.
13. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in full effect. These Terms, together with any policies posted on the Site, are the entire agreement between you and us regarding your use of the Site and your purchases.
14. Changes to These Terms
We may update these Terms at any time by posting the revised version on this page. The Terms in effect when you place an order govern that order.
